    Refund Policy and Return Exchange Process

    A product can be exchanged or refunded within 14 days of the purchase date subject to the terms and conditions listed below :

    Condition of Returned Products

    1. Our products must be returned in it’s original unused state, unworn state with it’s tag in perfect condition, along with the original Diadem box, with it’s tag in perfect condition, along with the original Diadem box, certificates and delivery package, including all accessories and documents.

    2. All components of the piece must be returned with the exact same status as in the original delivery package.

    3. If you have received free items, promotional items as part of your order, they must be returned with the products

    4. All returns will be subject to strict Quality Control (“QC”) by us to ensure that the returned products are in original condition without usage.

    If the returned product satisfies QC, we will proceed with the applicable refund or exchange. Initial shipping charges will be refunded if applicable.  

    All other costs like customs duties and taxes will have to be refunded by the buyer directly from the local authorities as per the process in each destination country.

    If the products do not meet QC standards, and / or we find alterations, replacement of material content, Diamonds and gemstones then we will refuse the return, and the products will be dispatched back to you without any refund at your own shipping cost.

    We reserve our right to not accept any return if the product shows signs of wear and usage, however as an alternative we may reduce the amount of refund or exchange value applicable.

    Only the buyer will be entitled to receive a refund of the purchase price with valid proof of identity.

    If the buyer complies with these conditions of sales and return, we will use commercially viable endeavours to refund the purchase amount using the most appropriate means of payment as used by the buyer for the initial transaction or otherwise within fourteen (14) days after receipt of the returned item by Diadem Client Relations Contact Centre.

    Product return process :

    1. Call or email our Client Relation/ Contact Centre, who will then send you a return form by e-mail.

    2. Please fill out the required information on the return form, sign it and email back. You may be asked at this stage to provide information, pictures, videos of the product to make a first assessment of the product condition.

    3. Our logistics partner or authorised company personnel will pick-up the sealed delivery package with the product inside on the agreed date. Or we may ask you to deliver the shipment to our corporate office in person.

    4. The return package will be opened under surveillance and if the contents are missing or incomplete inside the shipment a discrepancy will be filed with the logistics partner and our insurers. Accordingly the refund will be fulfilled only after validation from the insurers.

    Products you cannot return or exchange

    Products that have been personalized, custom designed and crafted in any way cannot be cancelled and such products cannot be returned to us for exchange or refund. This includes, without limitation, products that have been engraved or embossed

    Exchange

    You may opt for an exchange after the return has been validated and authorised and refund amount confirmed based on Conditions of Sales and Return and Refund Process stated above. 

    In any event, the sale of the returned product will be cancelled and a new order for the exchange product will be raised.

    For any repair inquiries relating to a product ordered through any of our sales channels please contact our Client Relations Contact Center.

    We Do not engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

    Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

    • Temporary blacklist of IP addresses associated with repeated failed transactions. This blacklist persists for a small number of hours.
    • Temporary blacklist of credit cards associated with blacklisted IP addresses. This blacklist persists for a small number of days.

    Protecting your information

    We want you to feel confident about using our Platform, and we are committed to protecting the personal information we collect. We limit access to personal information about you to employees who reasonably need access to it, to provide products or services to you or in order to do their jobs.     Minors

    Our sales online sales platform is not intended for transactions by individuals under the age of 18. We do not intentionally collect Personal Information from children.     By visiting our site and/ or purchasing something from us, you engage in “our Service” and agree to be bound by the following “Terms of Service and Sales Conditions” including those additional terms and conditions and policies referenced herein and/or available by hyperlink.     Placing an Order

    By placing an order through any of our online sales channels, you agree to the Terms and conditions of sale defined herein. You also represent and warrant that you are an end-user of a legal age as per your country laws and / or a customer purchasing for your own or another’s personal use and will not deliver, sell or otherwise distribute our products or purchase our products or services for commercial and re-selling purpose.

    All orders placed through the Sales Channels are subject to availability and acceptance of such orders by us.

    Product descriptions


    We are committed to ensuring that each product strictly complies with our quality criteria and that it has passed all our controls, both technical and aesthetic.

    We endeavor to ensure highest accuracy of information provided, including product descriptions, weights, dimensions, and colours, provided on the online sales Platforms, in advertisements or catalogues.

    However, we make no guarantees, whether express or implied, in relation to the accuracy, reliability and completeness of such information as it is based on the manufacturing data available at our end and may vary slightly or may differ in case of an oversight, error or negligence in expressing, writing or updating on the online platforms.

    Confirmation of Order & Shipment

    Upon shipment of your order, we will send you a Confirmation of Order & Shipment in writing (by e-mail or otherwise). This Confirmation of Order & Shipment constitutes our acceptance of your order and indicates the existence of a binding sales contract, except for personalized products, where our Acknowledgement of Order constitutes our acceptance of your order and indicates the existence of a binding sales contract.

    Delivery and Shipping

    All Deliveries within UAE are free of cost and paid by Diadem.

    Other than UAE Shipping Charges will be levied by the third party shipping agency like FEDEX or other integrated shippers on the online platform based on the country of destination.

    VAT, Custom Duties and Taxes

    All Prices quoted on any of the product pages are inclusive of 5% VAT applicable for UAE Clients and delivery within UAE only.

    Other than UAE; Sales Tax, VAT, Import Duties or any other form of taxes will be applicable and levied  as per the destination country’s laws and regulations.

    We reserve the right to modify prices and shipping costs without any prior notice and it will be reflected at the checkout page.

    Limitations of Liability

    To the fullest extent permitted by applicable law, Diadem, shall not be liable for any indirect, incidental, special or consequential damages, viruses and malwares, hacking, cyber crime of any kind arising out of or in connection with the use of information available from the Online Platforms or the world wide web search engines nor any liability relating to any loss of use, interruption of business, lost profits or lost data, regardless of the form of action, whether in contract, including negligence, or otherwise.

    Intellectual Property rights

    The intellectual property rights over the component parts of this Website, in particular the trademarks, models, logos and other distinctive marks, are the exclusive property of DIADEM and protected by the UAE IP Trade mark laws. Consequently, any partial or total reproduction of the component parts of this Website is strictly prohibited without DIADEM’s prior written authorisation.

    The “DIADEM” trademark, together with all trademarks, figurative or otherwise, and more generally all other trademarks, illustrations, images and logos featured on DIADEM articles, their accessories or packaging, whether protected by copyright or not, are and shall remain the exclusive property of DIADEM. Any total or partial reproduction, modification or use of these trademarks, illustrations, images and logos, for any reason and on any medium whatsoever, without DIADEM’s express and prior consent, is strictly prohibited.     You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.

The Service and all products and Services delivered to you through the Service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.


    In no case shall Diadem Jewellers, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility.

    Nothing in these Conditions of Sale limits or excludes our liability for any liability which cannot be limited or excluded by applicable law. Subject to the preceding sentence, our aggregate liability to you under these Conditions of Sale for any order whether in contract, tort (including negligence) or otherwise, even if we have been advised of the possibility of such damages shall in no event exceed the one hundred percent (100%) of the buying price of the product(s) in your order.


    Indemnification

    You agree to indemnify, defend and hold harmless Diadem Jewellers and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.


    General provisions

    If any provision, or part of a provision, of these Conditions of Sale is deemed to be illegal, invalid or unenforceable, the remainder of the provisions of these Conditions of Sale shall be unaffected and shall continue to be fully valid, binding and enforceable.

    These Conditions of Sale (and associated terms incorporated by reference) constitute the entire agreement between you and us in relation to the order of products or services, and replace and extinguish all prior agreements, draft agreements, arrangements, undertakings, or collateral contracts of any nature made by the parties, whether oral or written, in relation to such subject matter.

    We are not responsible for any failure or delay in performing or complying with our obligations under these Conditions of Sale which arises from any cause beyond our reasonable control.

    The waiver by us of a breach of any provision of these Conditions of Sale will not operate to be interpreted as a waiver of any other or subsequent breach.

    This contract is between us and you. No other person shall have any rights to enforce any of its terms.


    Governing Law; Agreement to Arbitration of Claims

    These Conditions of Sale shall be governed by and construed in accordance with the Federal Laws of UAE and Specifically Dubai Courts. Any dispute, controversy or claim arising out of or related to the Conditions of Sale, including the validity, invalidity, breach or termination of the Conditions of Sale, or to any product purchased from Diadem Jewellers through the Sales Channels, will be resolved by a binding arbitration or by the competent courts of Dubai and the federal UAE laws.

    Before bringing any dispute in arbitration, you and Diadem Jewellers agree that you will first notify the other party and make reasonable efforts for a period of thirty (30) days to resolve amicably any dispute or failure to agree that may arise out of or relate to the product, the Conditions of Sale or any potential or alleged breach thereof. This requirement is a pre-condition, and no claim shall be filed in arbitration (or small claims court) until this provision is first met.

    Confirmation of Order & Shipment


    Upon shipment of your order, we will send you a Confirmation of Order & Shipment in writing (by e-mail or otherwise). This Confirmation of Order & Shipment constitutes our acceptance of your order and indicates the existence of a binding sales contract, except for personalized products, where our Acknowledgement of Order constitutes our acceptance of your order and indicates the existence of a binding sales contract.

    Delivery and Shipping

    All ready stock will be delivered within 5 working days and stock not available may take upto 45 days for delivery.

    All custom created, made to order jewellery will be delivered as per the time frame agreed with our Client Relations Centre

    All Deliveries within UAE are free of cost and paid by Diadem.

    Other than UAE Shipping Charges will be levied by the third party shipping agency like FEDEX or other integrated shippers on the online platform based on the country of destination.

    VAT , Customs Duties and Taxes

    All Prices quoted on any of the product pages are inclusive of 5% VAT applicable for UAE Clients and delivery within UAE only.

    Other than UAE; Sales Tax, VAT, Import Duties or any other form of taxes will be applicable and levied as per the destination country’s laws and regulations.

    We reserve the right to modify prices and shipping costs without any prior notice and it will be reflected at the checkout page.
